New Delhi, Feb 12 (NationPress) The Supreme Court has revoked a bail decision made by the Allahabad High Court concerning an individual charged in a dowry death case, labeling it as "one of the most shocking and disappointing orders" encountered in recent times.

A Bench composed of Justices J.B. Pardiwala and K.V. Viswanathan endorsed the appeal lodged by the father of the deceased woman and mandated the accused—who is the husband of the deceased—to promptly surrender to the trial court and be placed in judicial custody.

The dowry death case was initiated at the Kotwali Bhinga Police Station in the Shrawasti district of Uttar Pradesh, citing violations of Sections 85 and 80(2) of the Bharatiya Nyaya Sanhita, 2023, as well as Sections 3 and 4 of the Dowry Prohibition Act, 1961.

According to the prosecution, the deceased woman, aged approximately 22 years, was married to the accused on March 1, 2025, and tragically died within three months of her marriage under mysterious circumstances at her matrimonial abode.

The FIR, filed by her father, claimed that despite providing Rs 3.5 lakh in cash and various dowry items at the time of the marriage, the accused and his family were still dissatisfied and sought an additional four-wheeler as dowry. It was further alleged that the woman experienced both physical and mental harassment and was discovered deceased on April 25, 2025, with marks of injury on her neck. The post-mortem report indicated that her death was due to "asphyxia from strangulation".

Expressing strong disapproval of the Allahabad High Court’s decision, the Supreme Court remarked: "The impugned order is one of the most shocking and disappointing orders that we have come across over a period of time."

The Justice Pardiwala-led Bench noted that while granting bail, the Allahabad High Court had merely acknowledged the defense counsel's arguments and issued bail on the basis that the accused had been incarcerated since April 27, 2025, and had no prior criminal record.

"We fail to grasp what the High Court intended to communicate in its order. What factors influenced the High Court's decision to grant bail in such a serious case as dowry death?" the order questioned.

The Supreme Court emphasized that the Allahabad High Court should have taken into account several critical factors, such as "the nature of the alleged crime", the penalties outlined in the BNS, 2023, the marital dynamics between the accused and the deceased, the crime scene, and the post-mortem results indicating strangulation as the cause of death.

"The impugned order has caused a travesty of justice," the Justice Pardiwala-led Bench asserted, adding that it was "unsustainable in law."

While specifying that it was not making any comments on the merits of the case since the trial is ongoing, the Supreme Court instructed the accused to surrender before the trial court without delay and ordered that he be placed in judicial custody upon surrendering.

Additionally, it directed the trial court to expedite the proceedings of the case and clarified that the determination of the accused's innocence or guilt would depend on the evidence presented during the trial. The bench also instructed the Supreme Court registry to send a copy of the order to the Registrar General of the Allahabad High Court for appropriate consideration by the Chief Justice of the High Court.
