Did Shahid Kapoor's 'O Romeo' Receive Clearance from the Bombay High Court?
Synopsis
Key Takeaways
Mumbai, Feb 7 (NationPress) In a significant boost for the producers of Shahid Kapoor starrer 'O Romeo', the Bombay City Civil Court has rejected a legal challenge aimed at halting the film's release.
This ruling followed an intense hearing, during which the Hon’ble Court balanced the claims of personality and privacy rights against the fundamental right to creative expression.
To recap, the lawsuit was filed by the daughter of the deceased Hussain Shaikh, who contended that the film’s representation infringed upon her father's privacy and tarnished his reputation.
However, it was argued during the proceedings that despite the film's public announcement in late 2024, the lawsuit was only submitted at the last minute, mere days before the film's anticipated release.
In its decision to dismiss the application, the Hon’ble Court further emphasized that the right to privacy is an individual right that ceases upon death, meaning it cannot be inherited or leveraged by family members to obstruct artistic creations.
The court acknowledged the film as a piece of fiction, reinforced by a clear disclaimer indicating that the characters depicted are fictional and any resemblance to real individuals is purely coincidental.
Moreover, it was successfully argued that stopping a film at the last moment would result in irreparable financial harm to the filmmakers and various stakeholders involved.
Directed by Vishal Bhardwaj and produced by Sajid Nadiadwala, 'O Romeo' is inspired by Hussain Zaidi’s novel 'Mafia Queens of Mumbai'.
Set against the backdrop of Mumbai's underworld, the narrative follows Hussain Ustara, a raw and emotionally conflicted gangster.
Featuring a stellar cast including Triptii Dimri, Nana Patekar, Avinash Tiwary, Disha Patani, Farida Jalal, and Tamannaah Bhatia, the film is slated for release in cinemas on February 13.
