Bombay High Court Upholds Shilpa Shetty’s Personality Rights: A Landmark Judgment
Synopsis
Key Takeaways
Mumbai, March 10 (NationPress) The Bombay High Court has issued a ruling that protects the personality rights of Bollywood star Shilpa Shetty from any unauthorized use.
According to the ruling, the Court has prohibited the defendants from utilizing or distorting her name, image, voice, likeness, or persona in any form.
Additionally, the Court has mandated the immediate removal of defamatory and infringing content from various platforms, reinforcing that the identity and reputation of a public figure cannot be commercially exploited or misused online without their permission.
This recent ruling places an obligation on digital platforms and intermediaries to take prompt action in erasing such unlawful content.
Commenting on this significant development, Supreme Court attorney Sana Raees Khan, who represents Shilpa, expressed her appreciation for the Court's decisive stance against deepfakes.
She stated, “The Bombay High Court has clearly asserted in the case concerning Ms. Shilpa Shetty’s personality rights that the internet should not serve as a playground for deepfakes and digital impersonation. The Court has upheld her personality rights and recognized that her name, image, voice, and persona constitute valuable legal rights that cannot be commercially exploited or digitally altered without her consent.”
“This ruling emphasizes that digital platforms and intermediaries are required to act swiftly in eliminating such materials and must prevent the misuse of technology that infringes upon her dignity and reputation,” the attorney further remarked.
Shilpa had approached the Bombay High Court in November 2025 to seek protection of her personality rights.
Recently, the High Court has scrutinized the legal status of various artificial intelligence tools designed to replicate celebrity personalities without obtaining consent.
It is important to note that Shilpa is not the first celebrity to receive legal safeguards against the exploitation of their persona online.
Prior to the 'Dhadkan' actress, numerous Bollywood icons like Kajol, Aishwarya Rai Bachchan, Shatrughan Sinha, Abhishek Bachchan, and Salman Khan, among others, have had their personality rights protected.
