Legal Action Taken by South Korean President Yoon's Attorneys Against Second Detention Warrant

Seoul, Jan 9 (NationPress) Attorneys for South Korean President Yoon Suk Yeol revealed on Thursday that they have submitted a request for an injunction against a second warrant for his detention linked to his temporary declaration of martial law.
Yun Gap-geun and other members of the impeached president's defense team made these statements during a press briefing with foreign media, indicating that the request was filed with the Constitutional Court, along with a plea for adjudication on a dispute regarding jurisdiction, as reported by Yonhap news agency.
The Seoul Western District Court issued the warrant on Tuesday following a request from investigators for an extension of their initial warrant that had lapsed the day before.
An attempt to enforce the warrant last Friday was thwarted when Yoon's bodyguards prevented investigators from accessing the official presidential residence.
A renewed attempt is anticipated in the upcoming days.
According to Yun, "The judge responsible for both the first and second warrants, as well as the judge who rejected our objection to the first warrant, not only misinterpreted the law but are also misapplying it." He added, "There are significant misinterpretations and exaggerations of the law that render it very likely illegal."
The legal team had previously taken similar measures against the first warrant; however, the Constitutional Court did not act on either request prior to the warrant's expiration.
Yun conveyed some of the president's sentiments as he remains out of public view since being impeached by the National Assembly on December 14.
"President Yoon appears to be in good health and is concerned that his purpose in declaring martial law may not be realized," the lawyer stated. "He hopes this will serve as an opportunity for the development of the Republic of Korea as part of our history."
When asked about Yoon's intentions, Yun mentioned that the president "believes that the martial law declaration is instrumental in fostering a spirit of resilience among our people."
Regarding whether Yoon intends to participate in the first oral arguments for his impeachment trial next Tuesday, Yun indicated that there are other matters to address first, and no definitive decisions have been made yet.
