Islamabad, Sep 14 (NationPress) The Human Rights Commission of Pakistan (HRCP) on Sunday issued a strong condemnation regarding reports that an 11-member committee of "elders" in Khyber-Pakhtunkhwa (KP) Swabi district has declared that all transgender individuals are to be expelled from the area.
HRCP stated, "The decision made by community elders in Swabi, Khyber Pakhtunkhwa, to establish a committee for the expulsion of transgender individuals is unconstitutional, discriminatory, and promotes violence against an already marginalized community." This was highlighted in a statement made on X.
The commission emphasized that "no individual should be deprived of the right to reside, pursue work, or earn a livelihood anywhere in Pakistan simply because of their gender identity."
It urged both provincial and district authorities to "immediately safeguard the rights and dignity of transgender individuals in Swabi and uphold their fundamental rights as outlined in the Constitution and the Transgender Persons (Protection of Rights) Act 2018."
The committee of elders reportedly includes Jamiat Ulema-i-Islam-Fazl's tehsil president, Maulana Abdul Samad Haqqani, among other members. Maulana Samad suggested that transgender individuals ought to leave the district amicably and seek livelihoods elsewhere, asserting that their presence promotes music events that "adversely affect the youth," according to leading Pakistani daily, Dawn.
Another committee member, Yasir Khan, mentioned that the initial approach would be to request the voluntary departure of transgender individuals, but should they refuse, the police would be notified.
The group is set to reconvene in the coming days to discuss strategies with law enforcement for the "expulsion" of transgender persons from the district.
This news follows the police's apprehension of over 200 individuals, including two transgender persons, during a raid on a music event in Swabi, citing allegations of resistance and use of "abusive language" against law enforcement, according to local media reports.
In response to the committee's announcement, members of the transgender community released a video firmly rejecting the demand for their expulsion.
They affirmed their respect for local customs and their right to earn a living, insisting that the elders had no authority to take the law into their own hands.
They also expressed their knowledge of the law and the Constitution, indicating a willingness to cease performing at events if government jobs were made available to them.
Appealing to society to view them through a humanitarian lens, they stressed that forcing them out of Swabi is unacceptable, as reported by local media.
