According to the guidelines set by the Election Commission of India, candidates must submit an affidavit using Form 26 at the time of nomination.

Due to the lack of clear information, Adhikari is requesting instructions from the court, with a hearing anticipated later this week.
This situation arises amidst several cases filed against him in recent years. In December 2022, Justice Rajasekhar Mantha of the Calcutta High Court instructed that no new FIRs could be registered against him without prior court approval.
However, on October 24, 2025, Justice Jay Sengupta lifted this protective order, stating that such interim relief could not be maintained indefinitely. Nevertheless, the court did grant partial relief by dismissing 15 cases against Adhikari, labeling them as either unfounded or politically driven.
Following this, a new case was opened regarding an alleged assault on his convoy in Chandrakona within the West Midnapore district. The High Court provided him with interim protection until February 19, 2026.
Given these developments, Adhikari has once again petitioned the court for a complete and updated account of all pending cases against him prior to filing his nomination papers.
