The division bench remarked that the single-judge bench failed to acknowledge that these educators had been in their positions for an extended period.
It was also noted that the prolonged political unrest in the hills previously halted the recruitment process for regular teachers.
Historically, there have been claims regarding the illegal appointment of teachers in GTA-controlled schools in the hilly areas, with allegations suggesting that these appointments occurred without formal notifications.
A petition was filed to seek the intervention of the Calcutta High Court on this matter. During the proceedings, the single-judge bench initially directed a probe by the Central Bureau of Investigation (CBI).
However, the state government contested this CBI probe directive before a division bench comprising Justice Harish Tandon and Justice Madhuresh Prasad, which ultimately upheld the single-judge bench's order.
The state government later appealed to the Supreme Court, which overturned the directive for a CBI investigation, assigning the Criminal Investigation Department (CID) to oversee the inquiry instead.
