Last month, the Haryana Congress Legislature Party submitted a memorandum to Governor Ashim Kumar Ghosh, raising concerns about alleged collusion between the BJP and the Election Officer during the Rajya Sabha elections for two seats.
The memorandum stated that the Legislative Assembly consists of 90 members, with 48 from the BJP, 37 from the Congress, two from the Indian National Lok Dal (INLD), and three Independent MLAs.
A total of 31 votes was necessary to secure one Rajya Sabha seat.
Typically, both the BJP and Congress were expected to win one seat each.
However, in a surprising turn, the BJP nominated its own Vice-President, Satish Nandal, as an Independent candidate, supported by seven BJP MLAs who acted as proposers.
The Congress labeled this as a blatant example of political horse-trading, involving inducement, intimidation, institutional pressure, and the misuse of governmental resources by the ruling party.
The memorandum also criticized the Election Officer, Pankaj Agarwal, for his biased conduct.
It asserted that he invalidated valid votes cast by Congress MLAs, while accepting votes for the BJP and the Independent candidate, deliberately ignoring valid objections raised by Congress vote-counting agents.
The Congress has lodged a formal complaint with the Election Commission regarding these issues.
In their memorandum, the Congress Legislature Party urged the Governor, as the state's constitutional guardian, to initiate an inquiry into this unethical and undemocratic behavior, and to direct the government to uphold democratic principles, integrity, and discipline, ensuring appropriate action against the Election Officer.
