Prayagraj, Feb 21 (NationPress) A Special POCSO Court in Uttar Pradesh's Prayagraj has mandated the filing of an FIR and initiated an inquiry into allegations that Swami Avimukteshwaranand was implicated in the sexual abuse of minors, as reported by a lawyer on Saturday.
Special POCSO Judge Vinod Kumar Chaurasia instructed the head of Jhunsi Police Station to register the FIR based on a complaint lodged by Jagadguru Rambhadracharya's disciple, Ashutosh Brahmachari.
Brahmachari submitted an application in accordance with Section 173(4) of the Bharatiya Nagarik Suraksha Sanhita (BNSS) Act.
This section allows any individual who feels wronged by the refusal of a police officer to record information to approach a Magistrate for redress.
During the in-camera trial, Brahmachari introduced two minors before the Special Protection of Children from Sexual Offences (POCSO) Act Court.
The Special Court had previously reserved its order on his application as of February 13.
Following a review of a preliminary inquiry report submitted by Prayagraj Police Commissioner Jogendra Kumar, the Special Court directed that an FIR be lodged against Swami Avimukteshwaranand, his disciple Mukundanand, and two others, while further investigations were ordered.
Earlier, Swami Avimukteshwaranand gained attention when the Supreme Court refused to consider a Public Interest Litigation (PIL) alleging police misconduct against his followers during the Magh Mela held from January 3 to February 15 in Prayagraj.
The bench, led by Chief Justice of India (CJI) Surya Kant, noted that matters of law and order are under the jurisdiction of the state government and advised the petitioner to approach the relevant authorities for appropriate actions.
Controversy arose during the auspicious Mauni Amavasya bathing festival at the Magh Mela when Swami Avimukteshwaranand attempted to proceed to the Sangam in a traditional palanquin.
The administration halted the procession due to safety concerns and the enforcement of a no-vehicle zone policy in light of the heavy turnout.
A scuffle ensued between the Swami's disciples and police, leading to allegations of police brutality.
In response, Swami Avimukteshwaranand staged a dharna and reportedly refused food and water, demanding an apology from the authorities.
The standoff escalated after the Magh Mela Authority issued a notice challenging his right to the title 'Shankaracharya'.
