Lucknow, April 17 (NationPress) The Allahabad High Court has instructed the Uttar Pradesh Police to initiate an investigation and contemplate filing an FIR regarding the purported dual citizenship of Rahul Gandhi, the Leader of Opposition in the Lok Sabha, as stated by a legal representative on Friday.
Justice Subhash Vidyarthi issued this directive following a petition from S. Vignesh Shishir, a BJP member from Karnataka, who contested a January 28 ruling by a special MP/MLA court in Lucknow that dismissed his request for an FIR against the Congress leader.
The Lucknow Bench of the High Court remarked that the accusations regarding Rahul Gandhi's dual citizenship necessitate a thorough inquiry.
The petitioner appealed to the High Court against the lower court’s determination that it lacked the authority to adjudicate matters concerning dual citizenship, which also questioned his eligibility to serve as a Member of Parliament from Rae Bareli.
Shishir has sought the registration of an FIR and a comprehensive investigation, claiming violations under the Bharatiya Nyaya Sanhita (BNS), the Official Secrets Act, the Foreigners Act, and the Passport Act.
He asserts that he possesses documentation and various emails from the British government substantiating that Rahul Gandhi is indeed a British citizen, thereby rendering him ineligible to participate in elections in India and to retain his position as a Lok Sabha member.
Shishir had previously lodged a complaint against the Congress leader in a special MP/MLA court in Rae Bareli, and this case was transferred to the Lucknow Bench of the High Court on December 17, 2025.
Recently, Assam Chief Minister Himanta Biswa Sarma launched a pointed critique of Rahul Gandhi, demanding clarity regarding his overseas travels.
“Before accusing others, Rahul Gandhi should be transparent about his own passport and international trips. I am willing to present my passport and those of my entire family to the media. I challenge Rahul Gandhi to do the same — only then will we know about his travels,” asserted CM Sarma.
He further urged Gandhi to openly address the public concerning the allegations made against him over the last decade, adding, “A person who makes accusations must also be ready to respond to inquiries.”
