Kochi, March 27 (NationPress) - The Kerala High Court has instructed the Election Commission of India (ECI) to evaluate a complaint regarding alleged communal statements made by BJP candidate B. Gopalakrishnan within a two-month timeframe. This directive was issued by Justice Bechu Kurian Thomas while resolving a writ petition brought forth by Gokul, a leader of the Kerala Students’ Union (KSU).
The petitioner has called for action against the NDA candidate, asserting that he has breached election regulations through purportedly communal posts on social media.

These statements led to legal repercussions, prompting the Guruvayoor Temple Police Station to file a case under both the Bharatiya Nyaya Sanhita and the Representation of the People Act.
During court proceedings, it was acknowledged that a First Information Report (FIR) has already been filed regarding this matter and that the contentious video has been removed.
The court also noted that the petitioner had lodged a formal complaint with the Election Commission of India, which is still awaiting a response.
In its ruling, the court stressed the importance of allowing the ECI to thoroughly assess the case since the formal complaint process has not been fully utilized yet.
The bench refrained from making any substantive comments on the credibility of the allegations, given the ongoing electoral activities.
“Given that the election process is already underway, it would not be suitable for the Court to make any remarks that could influence the upcoming election,” stated the Court, while instructing the ECI to render a decision on the representation within two months of receiving the directive.
With this ruling, the petition was resolved, leaving it to the Election Commission to determine the next steps in this politically charged situation.
