Kochi, Nov 29 (NationPress) The Kerala High Court on Saturday consented to view the Malayalam film 'Haal' prior to making a decision on a writ appeal lodged by the Catholic Congress. This appeal challenges the ruling of the Single Judge, who annulled the A-certificate and the cuts enforced on the film by the Central Board of Film Certification (CBFC).
The Division Bench, which includes Justice Sushrut Arvind Dharmadhikari and Justice P.V. Balakrishnan, stated that if the film is found devoid of objectionable content, the appellant may incur exemplary costs.
The Bench highlighted that the Single Judge had already viewed the film last month and ruled in favor of the filmmakers.
"If we find nothing objectionable, costs will be imposed. The learned Single Judge has already viewed it, so why doubt his judgment? However, since this is an appeal, we must see it ourselves," the Bench commented.
The judges also warned that exemplary costs would be enforced if the appeal is rejected.
The Court instructed the attorney for the Catholic Congress to submit a memo detailing the specific timestamps in the film where they allege objectionable content exists.
Additionally, an interim order was issued mandating a screening of the film for the judges on Wednesday, December 3, after 7 p.m.
"The learned counsel for the first respondent is requested to organize the screening of the movie on Wednesday... both counsels are required to be present at the venue where the film, accompanied by English subtitles, will be shown," the order specified.
In a lighter moment during the hearing, Justice Dharmadhikari remarked, "This will be my first Malayalam movie. Chalo, it should be an enjoyable experience."
The case has been scheduled for additional consideration on December 4, following the judges' viewing of the film.
