Kannur, Nov 15 (NationPress) In a significant ruling regarding the sexual assault of a Class 4 girl at Palathayi in Kerala, former Bharatiya Janata Party (BJP) leader and educator K. Padmarajan was sentenced to life imprisonment along with financial penalties.

Additionally, he received a total of 40 years of imprisonment due to the charges under POCSO.

This verdict was handed down by the Thalassery Fast-Track POCSO Court.

On Friday, the court found Padmarajan guilty.

The charges against him carry penalties ranging from a maximum of 20 years to life imprisonment.

This case generated considerable political controversy as the investigation team underwent five changes, and the initial charge sheet did not incorporate POCSO sections.

The accusations included Section 376AB (rape) and violations of the POCSO Act.

Padmarajan was convicted of sexually assaulting a 10-year-old girl both inside and outside her school in Palathayi, on three occasions between January and February 2020.

The complaint was referred to the Thalassery Deputy Superintendent of Police by the Panoor Police.

Initially, police investigations concluded that the complaint was unfounded.

However, widespread public protests followed due to the lack of action against the accused.

On April 15, 2020, Padmarajan was apprehended from a relative's home where he had been evading arrest.

The investigation was subsequently handed over to the Crime Branch.

Without including the POCSO charges, the Crime Branch submitted a charge sheet just hours before the 90-day deadline.

After the case was handled by five different investigation teams, the final charge sheet was presented in May 2021.

The trial commenced in February 2024, culminating in the POCSO Court finding the accused guilty.

The prosecution asserted on Friday that the survivor achieved justice on Children's Day (November 14) and that the accused warranted the severest punishment.

Prior to sentencing, the prosecution reiterated its plea for the maximum penalty.

The defense contended that the case was politically motivated.

Padmarajan requested clemency, citing his family comprising a wife, children, and mother.

The court clarified that it considered only the merits of the case.

In the meantime, senior CPI-M leader and former legislator M.V. Jayarajan commended the court's decision, asserting that the ruling was devoid of political bias.
