Kolkata, June 9 (NationPress) Wajahat Khan, the individual whose FIR at the Garden Reach police station on May 15 resulted in the detention of 22-year-old law student Sharmishta Panoli from Gurugram on May 30, was apprehended by the Kolkata Police on Monday.
While Panoli faced allegations of offending the religious sentiments of a specific community and inciting hatred through a social media video, Khan was also detained on similar counts of disseminating hate speech and offending religious feelings via social media.
An FIR was filed against Khan at the Golf Green police station in Kolkata, prompted by a complaint from the independent organization Shree Ram Swabhiman Parishad, accusing him of disparaging Hindu deities, rituals, and the community.
Three successive notices were issued at Khan's residence in Garden Reach, requesting his presence for questioning at the local police station.
Despite this, Khan remained elusive until his arrest by city police officials on Monday.
Previously, on June 5, the Calcutta High Court granted interim bail to Sharmishta with a personal bond of Rs 10,000.
In granting her bail, the court remarked that the arrest warrant issued against her was mechanical, lacking proper evaluation of whether a cognizable offense was present.
The court further noted that the notice-serving process was ongoing while she was outside Kolkata.
Khan's FIR against Sharmishta, filed on May 15, was in response to an Instagram video in which she made objectionable remarks regarding 'Operation Sindoor', reportedly hurting the religious sentiments of a specific community.
Following intense backlash, the law student removed the video and issued a public apology.
Nonetheless, she was arrested on May 30 in Gurugram.
On May 31, a trial court in Kolkata placed her in judicial custody until June 13.
The BJP’s Bengal unit criticized the rapid action taken by the Kolkata Police against her, labeling it a 'vote bank vendetta.'
