Did the Madras HC Dismiss Charges Against BJP's Amit Malviya Over Udhayanidhi's Comments on Sanatan Dharma?
Synopsis
Key Takeaways
Chennai, Jan 21 (NationPress) The Madurai Bench of the Madras High Court has dismissed a criminal case initiated by the Trichy City Crime Branch against Amit Malviya, a prominent member of the Bharatiya Janata Party (BJP). This case was related to a social media post that referenced remarks made by Udhayanidhi Stalin concerning Sanatan Dharma.
The legal action originated from a complaint lodged by Advocate Dinakaran, the district organiser of the DMK Advocates’ Wing.
The complaint, filed at a Trichy police station, claimed that Malviya's post on the social media platform X could incite communal unrest.
This controversy dates back to a speech delivered in 2023 by Udhayanidhi Stalin, who is the Youth Welfare and Sports Development Minister of Tamil Nadu, at the 'Sanatana Abolition Conference' hosted by the Tamil Nadu Progressive Writers and Artists Association.
During his address as a special guest, the Minister differentiated between ideas that should be opposed and those that should be eliminated.
In his remarks, Udhayanidhi Stalin equated social evils with diseases such as dengue, malaria, or coronavirus, asserting that these should not merely be opposed but eradicated.
He suggested that Sanatan too should be eradicated rather than just opposed, stating that the conference's title was fitting.
Amit Malviya later shared a video clip of this speech on X, asserting that Udhayanidhi Stalin, son of Tamil Nadu Chief Minister M.K. Stalin, had drawn a comparison between Sanatana and fatal diseases, thereby calling for its elimination.
Malviya further claimed that such remarks could be construed as a call for genocide against the populace of India.
In response to the complaint, the Trichy City Crime Branch filed charges against Malviya under Sections 153 and 153A of the Indian Penal Code, which address the promotion of enmity and actions detrimental to communal harmony.
Contesting the case, Malviya sought the High Court's intervention to quash the proceedings. After consideration, Justice Srimathi approved the petition, leading to the dismissal of the criminal proceedings against Malviya.
