The BJP welcomed the Madras High Court's ruling that dismissed the criminal case against BJP IT cell chief Amit Malviya, initiated by the Trichy City Crime Branch regarding a social media post, labeling the remarks made by the DMK minister as hate speech.
The High Court noted in its ruling on Tuesday that Udhayanidhi Stalin's statements concerning Sanatana Dharma in 2023 had sparked a significant political uproar nationwide, qualifying them as hate speech.
During a press conference at BJP headquarters, spokesperson Shehzad Poonawala criticized the DMK government for filing a fabricated case to target the BJP leader and alleged it was utilizing state agencies to pursue its political adversaries.
“I want to question the ecosystem, where is the free speech for Amit Malviya?” he asked.
Poonawala further demanded the immediate dismissal of the DMK minister for his hateful remarks about Sanatan Dharma and insisted that legal action should be taken against him.
“Though Congress claims to advocate for Hindus, they remain silent in the face of Udhayanidhi Stalin’s blatant call for the extermination of Hindus. When will Congress demand that the state government act against Udhayanidhi Stalin?” Poonawala pressed.
Applauding the Madras High Court's decision, the BJP leader remarked, “Satyamev Jayate. Truth ultimately prevails.”
This ruling pertains to a case perceived as retaliatory and politically vindictive, as the DMK government initiated it solely to harass and persecute Amit Malviya for voicing the truth,” he stated.
Poonawala noted that Udhayanidhi Stalin, the son of TN CM MK Stalin, had previously called for not just opposing Sanatana but for its absolute abolition and eradication.
“When these comments were highlighted by Amit Malviya, rather than taking action against Udhayanidhi Stalin, the entire DMK apparatus, including the police and other agencies, was deployed to vindictively target Amit Malviya,” the BJP leader highlighted.
“No action was taken regarding Udhayanidhi Stalin's toxic statements; instead, action was taken against those who, as Hindus and adherents of Sanatana, raised this concern,” he added.
It is noteworthy that the Madurai bench of the Madras High Court annulled the FIR lodged in 2023 against BJP leader Amit Malviya for purportedly misrepresenting Udhayanidhi Stalin’s remarks, branding the latter’s comments as ‘hate speech’.
Moreover, the court observed that no criminal proceedings were initiated against the Minister in Tamil Nadu related to his alleged hate speech, although cases have been filed in other states.
This controversy traces back to September 2023 when Udhayanidhi Stalin ignited a nationwide discussion with his comments on Sanatana Dharma during a public event.
“Some things cannot merely be opposed; they must be eradicated. We cannot oppose dengue, mosquitoes, malaria, or COVID; we must eliminate them. Similarly, we must eradicate Sanatana, instead of just opposing it,” he stated.
These remarks attracted intense criticism from various sectors, with BJP and Hindu organizations describing it as an “open call for genocide” against followers of Sanatana Dharma.
