Did the Madras HC Dismiss the Police Case Against BJP Leader Malviya for His Comments on Udhayanidhi's Views on Sanatan Dharma?
Synopsis
Key Takeaways
Chennai, Jan 21 (NationPress) The Madurai Bench of the Madras High Court has dismissed a criminal case initiated by the Trichy City Crime Branch against Amit Malviya, a prominent member of the Bharatiya Janata Party (BJP). This case was related to a social media post addressing comments made by Udhayanidhi Stalin regarding Sanatan Dharma.
The case originated from a complaint lodged by Advocate Dinakaran, who serves as the district organiser for the DMK Advocates’ Wing.
The complaint alleged that Malviya's post on the social media platform X could incite communal discord.
This controversy began with a speech given by Udhayanidhi Stalin in 2023 during the 'Sanatana Abolition Conference' hosted by the Tamil Nadu Progressive Writers and Artists Association.
In his address as a special guest, the Minister distinguished between ideologies that should merely be opposed and those that should be completely eliminated.
He compared social evils to diseases like dengue, malaria, or the coronavirus, stating that these should not merely be opposed but eradicated.
By this analogy, he suggested that Sanatan should also be eradicated instead of just opposed, claiming the conference's title was fitting.
Amit Malviya subsequently shared a video clip of this speech on X, asserting that Udhayanidhi Stalin, son of Tamil Nadu Chief Minister M.K. Stalin, had equated Sanatana to lethal diseases and effectively called for its eradication.
Malviya further contended that such statements amounted to advocating genocide against India’s citizens.
In light of this complaint, the Trichy City Crime Branch filed charges against Malviya under Sections 153 and 153A of the Indian Penal Code, which pertain to promoting enmity and actions detrimental to communal harmony.
Challenging these charges, Amit Malviya approached the Madurai Bench of the High Court seeking their dismissal. After considering his arguments, Justice Srimathi granted the petition and ordered that the charges against Malviya be dismissed, effectively concluding the case.
