During the proceedings of Original Application No. 38/2025 (CZ), presided over by Judicial Member Justice Sheo Kumar Singh and Expert Member Ishwar Singh, the court responded to a plea filed by Vishnu Kumar Vaishnav, who reported extensive encroachments and environmental breaches impacting crucial water bodies in the area.
The applicant pointed out that water bodies like Dharmo Talab and Fateh Sagar—locally referred to as Baba Talab—have faced illegal occupations and actions harmful to the ecosystem. He presented joint committee inspection reports and official revenue documents from the Tehsildar, which substantiate the presence of encroachments on these designated water bodies. The applicant further asserted that the authorities' ongoing inaction has resulted in the deterioration of these water bodies, raising significant environmental and public interest issues.
Legal representatives for the state informed the Tribunal that the matter involves encroachments on acknowledged water bodies and confirmed that steps are being taken under relevant revenue and environmental laws.
The state government recognized the findings reflected in the official documentation and stated that the district administration is initiating necessary actions. After reviewing the arguments, the Tribunal emphasized that the safeguarding of water bodies is critically important and necessitates immediate action from the authorities. In its interim ruling, the NGT instructed the District Collector of Bhilwara to swiftly undertake all lawful actions to protect the water bodies and ensure the removal of encroachments in line with due legal processes.
The Tribunal also permitted affected or interested parties to submit applications for impleadment within two weeks, provided that advance copies are served to opposing parties.
