New Delhi, March 11 (NationPress) The BCCI Ethics Officer, Justice Arun Mishra, has ruled out a conflict-of-interest allegation against former Indian cricket captain MS Dhoni, stating that there was no substantial proof of any infringement of the board's guidelines.
The complaint, submitted in February 2024, asserted that Dhoni was violating rules by being both a current player and the proprietor of a cricket academy. This was claimed to contravene Rule 38(4)(a) and Rule 38(4)(p) of BCCI's conflict-of-interest regulations. Additionally, it alleged that he failed to comply with disclosure mandates under Rules 38(2) and 38(5) after the regulations were amended in 2018.
In his comprehensive ruling, Justice Mishra noted that Dhoni could be recognized as the owner of cricket academies operated by M/s Aarka Sports and Management Private Limited.
"Consequently, Shri MS Dhoni can indeed be identified as the owner of the cricket academies established by M/s Aarka Sports and Management Private Limited. However, the agreement was made in 2017, while the regulations took effect in September 2018. Therefore, no conflict of interest was established at the time when Shri MS Dhoni represented India as Captain/Player," the ruling stated.
The Ethics Officer also expressed skepticism regarding the complainant's motives, suggesting that the complaint seemed to stem from a personal grievance rather than a legitimate regulatory concern.
"There was no indication of institutional control or decision-making authority, nor were there any signs of favoritism, bias, or preferential treatment," noted the ruling.
However, he emphasized that the agreement for the academies was signed in 2017, prior to the enforcement of the BCCI's conflict-of-interest guidelines.
"The complainant cannot effectively advocate for a third party in this adjudicatory setting. Moreover, the complainant appears to have a personal vendetta as the respondent caused him financial loss," the ruling stated.
It further remarked that the matter appeared to originate from a commercial dispute and that the complaint was filed after a significant delay.
"Given the preceding discussion and findings, the complaint is hereby dismissed," the ruling concluded.
Dhoni, who presently plays for the Chennai Super Kings in the Indian Premier League, is celebrated as one of the league's most accomplished captains, having led the team to five IPL championships.
