Key Takeaways
Bengaluru, Feb 23 (NationPress) A new development has emerged in the gang rape case involving a 19-year-old college student in Bengaluru. According to police reports on Monday, one of the accused has filed an FIR against both the victim and a journalist in the city.
The FIR was initiated by 34-year-old Nikhil H.D., who has been identified as a suspect in the case, with the Malleshwaram police having registered the complaint.
Nikhil approached law enforcement prior to the victim.
The FIR stemming from Nikhil's allegations was filed on February 21, while the FIR concerning the alleged drugging and gang rape was registered a day later, on February 22.
Authorities have charged the victim in the gang rape case under Section 66(D) (cheating by impersonation using computer resources or communication devices) of the Information Technology Act and Section 308(2) (extortion) in conjunction with Section 3(5) (criminal liability for actions taken in furtherance of common intention) against her and journalist Imran, among others.
Nikhil claims he is involved in the business of selling second-hand vehicles and had rented a villa in Jakkur for a one-day lease.
From February 14 to 16, his friend Deekshan had reserved the villa for a Valentine's Day gathering.
Nikhil stated that he joined the celebration at around 2 a.m., where he was introduced to Deekshan's female friend and the victim.
Nikhil recounted, "While we were enjoying the party, the victim confided that her parents were undergoing a divorce and that her father was battling cancer, which deeply affected her. She mentioned feelings of depression and even moved closer to me, prompting me to ask her to refrain from such behavior."
"After the party, the victim requested me to give her a ride home. Once in the car, she again spoke intimately and referred to herself as a 'sugar baby' seeking a 'sugar daddy.' She asked me to message her if I knew anyone fitting that description. I assured her I would inform her and dropped her off near a bakery in Rajajinagar."
Nikhil further alleged, "On February 18, I noticed the victim making claims on Instagram regarding being drugged and gang-raped. A few days later, a man named Imran contacted me, claiming to be the Crime Chief of a Kannada news outlet. He instructed me to meet him at a designated location to pay the victim for her 'justice,' threatening that if I did not comply, he would air a promotional video that would ruin my reputation."
Nikhil has sought legal recourse against these individuals, asserting they attempted to extort money from him.
The 19-year-old college student from Bengaluru has accused her boyfriend and his friend of drugging and gang-raping her earlier this month.
A case has been documented at the Amruthahalli Police Station, and an investigation is currently in progress.
Police have charged the accused with Sections 64 (repeat rape offence), 70(1) (gang rape), and 351(2) (criminal intimidation) in conjunction with Section 3(5) (common intention) of the Bharatiya Nyaya Sanhita.
The victim, originally from Tamil Nadu, is studying journalism and psychology at a prestigious college in Bengaluru.
For the past five months, she has been residing in a PG hostel with a female friend.
The victim claims that at the Valentine's Day party, the accused forcibly administered a rose-colored tablet to her. Within ten minutes, she reported feeling an intense warmth, excessive sweating, dizziness, and blurred vision.
Upon regaining consciousness, she found herself partially unclothed.
Nikhil was beside her, allegedly with his hand on her chest. Disturbed, the victim pushed him away and covered herself with a bedsheet while inquiring about Dickson.
Nikhil allegedly exited and returned with another accused, Dickson, while she remained in a semi-conscious state.
The victim has alleged that the accused then removed her clothing and assaulted her sexually, despite her resistance and cries for help, asserting that the act would strengthen their connection.
After the assault, both accused purportedly left the room, locking the victim inside.
In her dazed state, the victim managed to gather her clothing and dress herself. She found her mobile phone under a pillow and alleged that during the drive back, Nikhil threatened her with severe repercussions if she revealed the incident.
The victim claimed Nikhil also touched her inappropriately during the drive before dropping her off near Lulu Mall.
Initially, the victim was too frightened to report the incident to the authorities.
The trauma from the incident lingered, and on February 17, she sought medical assistance at a hospital. After informing her brother about the ordeal, she subsequently filed a complaint at the Amruthahalli Police Station against the accused, Dickson and Nikhil.
Police have stated that further investigations are ongoing.
