Patna, May 23 (NationPress) A local court in Bihar's Darbhanga district has sentenced BJP MLA Mishrilal Yadav to three months' imprisonment in relation to the 2019 assault incident. District and Additional Sessions Judge Suman Kumar Diwakar rejected Yadav's appeal for leniency and mandated immediate incarceration.

The case involves allegations against Yadav and his associates for allegedly assaulting Umesh Mishra, a resident of Samaila, on January 30, 2019.

Following Mishra's complaint, local police submitted a charge sheet, and the court acknowledged the case on April 17, 2020.

Earlier, Yadav was convicted by the MP-MLA court, receiving a three-month jail sentence and a fine of Rs 500.

Subsequently, Yadav sought clemency and appeared before the court on Thursday, aiming for a favorable ruling.

However, Special Judge Karunanidhi Prasad Arya ordered his 24-hour judicial custody before the final verdict was delivered.

The court stated, "Yadav's presence was essential for the proceedings on May 23, when the sentencing was to be finalized."

After the hearing on Thursday, Yadav informed the media that the Additional District Judge did not consider his appeal for forgiveness and instead mandated his detention.

He claimed, "This case is politically motivated. I presented my petition, but was instead sent to jail. We are in the process of appealing to the High Court."

Upon reviewing the case, the court on Friday reaffirmed the sentence, directing the BJP MLA to serve his term at Mandal Jail in Darbhanga.

Post-verdict, Yadav reiterated his stance, labeling the case as "politically driven" and expressed his intent to appeal.

He stated, "The court has upheld the previous ruling of a three-month jail term and a Rs 500 fine. While I am heading to jail, I will challenge this decision in the Patna High Court. We trust the judiciary and believe justice will prevail in the end."

Point of View

It is essential to highlight the complexities surrounding this case. While allegations of politically motivated actions are common in the realm of politics, it is crucial to respect the judicial process and its outcomes. The legal system must be allowed to operate independently, ensuring that justice is served fairly.
