Patna, July 23 (NationPress) Following the Patna High Court's decision to overturn his criminal conviction, BJP MLA from Alinagar (Darbhanga), Mishrilal Yadav, met with Bihar Assembly Speaker Nand Kishore Yadav on Wednesday. He presented the court's order and requested the reinstatement of his Assembly membership.
Yadav, who had lost his position after receiving a two-year prison sentence from the Darbhanga MP-MLA court in a case dating back to 2019, expressed his satisfaction with the High Court's verdict.
“I am relieved to have received justice. I was wrongly accused due to a conspiracy, but the truth has prevailed,” Yadav stated.
The legal matter stemmed from a January 2019 FIR lodged by Umesh Mishra, a resident of Samaila village, claiming that Yadav and his associates assaulted him.
After a thorough investigation, the police submitted a charge sheet, and the court acknowledged the case on April 17, 2020.
On February 21, 2024, the lower court found Yadav guilty under Section 323 of the Indian Penal Code (voluntarily causing hurt) and sentenced him to three months of imprisonment along with a fine of Rs 500.
Unhappy with the ruling, the MLA sought clemency and appeared in court on May 22, 2025, in hopes of obtaining relief.
Following his appeals, the court increased the punishment. District and Additional Sessions Judge Suman Kumar Diwakar sentenced both Yadav and Suresh Yadav to two years of rigorous imprisonment and imposed a fine of Rs 1 lakh each.
Mishrilal Yadav was elected as an MLA from Alinagar in 2020 on a Vikassheel Insaan Party ticket, later switching allegiance to the Bharatiya Janata Party (BJP).
He has a history of serving as a Mukhiya and a Legislative Councillor before his election as MLA.
His membership was annulled following the lower court's conviction; however, he cast his vote in support of the NDA during the Nitish government's 2024 trust vote before his membership was officially revoked.
Looking to the future, Yadav has indicated his desire to run in the 2025 Assembly elections under the BJP banner, expressing hope that the party will provide him another opportunity.
