Himachal High Court Rejects Singhvi's Petition Against 2024 RS Election Outcome

Shimla, April 10 (NationPress) In a pivotal update regarding the ongoing Rajya Sabha election petition, BJP's Harsh Mahajan has received significant legal backing as the Himachal Pradesh High Court dismissed a motion brought forth by Congress's senior leader, Abhishek Manu Singhvi, on Friday.
Advocate Vikrant Thakur, representing Mahajan, informed the press that Singhvi contested the requirement for witness examination and cross-examination in this case, claiming that evidentiary proceedings were unnecessary.
The matter was thoroughly debated in court. Nonetheless, the court clarified that an election petition “is fundamentally trial-based, thus making evidence and witness examination essential for a just adjudication process”.
Additionally, the court noted that the witness list provided by BJP MP Mahajan was valid and adhered to legal standards. As a result, Singhvi’s application was rejected.
This ruling is viewed as a vital move in upholding the principles of transparency and due process in electoral disputes.
Advocate Thakur remarked: “The court has confirmed that election trials must not circumvent evidentiary examination. Witness interrogation is crucial to reveal the truth and achieve justice.”
In response to the court's ruling, Mahajan, a former state Cabinet Minister and a defector from Congress, stated: “Efforts to conceal the truth have been thwarted. The Congress leadership was attempting to evade a comprehensive and fair trial, but the court has emphasized that facts and evidence cannot be overlooked.”
He further criticized, “When evidence is lacking, Congress shies away from scrutiny. We firmly stand by the truth and are prepared to answer any questions on any platform.”
Following this decision, the case will advance with the evaluation of evidence and witness testimonies as part of the trial process.
In February 2024, BJP's Mahajan, previously associated with Congress and close to Himachal Pradesh Chief Minister Sukhvinder Sukhu, was elected to the Rajya Sabha. Notably, Mahajan and his Congress adversary Singhvi each garnered 34 votes in the 68-member assembly, but Mahajan was declared the victor through a draw of lots.
Post-Rajya Sabha elections, six Congress MLAs who participated in cross-voting were disqualified, namely Rajinder Rana, Sudhir Sharma, Inder Dutt Lakhanpal, Devinder Kumar Bhutoo, Ravi Thakur, and Chetanya Sharma.
