Kochi, July 17 (NationPress) The Kerala High Court on Thursday granted relief to Chief Minister Pinarayi Vijayan by staying the proceedings in the criminal case initiated against him for his 2023 'Nava Kerala Sadas' address, which was purportedly accused of inciting political violence.
Justice V.G. Arun issued an interim stay for three months while considering the CM's appeal against the Ernakulam Chief Judicial Magistrate's order that had taken cognizance and mandated sanction proceedings.
The Magistrate had acknowledged a complaint from Congress leader Muhammed Shiyas, who claimed that CM Vijayan's remarks made after black flag protests in Kannur on November 2023 had incited attacks on Youth Congress members throughout Kerala.
This case originated from an event on November 20, 2023, when Youth Congress members attempted to block the CM's convoy during the statewide Nava Kerala Sadas tour.
In his plea to the High Court, the CM argued that the contested speech, delivered a day following the incident, merely commended the bystanders who had intervened to prevent protestors from falling in front of his moving bus.
The address described their actions as “life-saving” and did not incite any violence or retaliation, according to the petition.
CM Vijayan is seeking to dismiss the proceedings against him in the alleged case of instigation related to crimes that occurred during the Nava Kerala Sadas tour.
The petition highlighted that, “despite the police's report under Section 202 CrPC finding no evidence against the petitioner, the Magistrate dismissed this negative report and concluded that the petitioner’s remarks prima facie constitute instigation of criminal offenses.”
The statewide yatra garnered significant media attention as opposition workers protested vehemently, leading to the police filing three FIRs against unidentified individuals involved in these incidents.
Notably, the highlight of the statewide yatra was CM Vijayan traveling across the state in an advanced luxury bus, accompanied by his entire cabinet and the chief secretary.
With this stay order, the CM's camp has expressed a sense of relief.
