New Delhi, Feb 24 (NationPress) BJP’s head of the Information Technology Cell, Amit Malviya, has firmly stated that he will not withdraw the criminal action against Santanu Sinha, a member of Hindu Samhati, who made false and defamatory allegations against him last year, according to a legal representative on Monday.

Sinha, affiliated with the right-wing group established in 2008 by Tapan Ghosh after departing from the Rashtriya Swayamsevak Sangh (RSS), had made objectionable remarks about Malviya on social media on June 7, 2024.

Recently, Sinha filed an affidavit in the Delhi High Court seeking to dismiss the criminal charges against him, a request that Malviya has contested.

While Sinha has submitted an unconditional apology and deleted the offensive posts, he argues that there should be no further action taken against him.

Conversely, Malviya’s legal team is insisting that Sinha should face trial, despite his apology and the removal of the contentious posts.

The BJP leader contends that simply deleting a post after making unsubstantiated and defamatory allegations is insufficient, and he has maintained that the prosecution against Sinha should continue.

Following Sinha’s objectionable comments, Malviya had demanded an apology and the removal of the remarks.

In a legal notice, he stated, "I, the undersigned, urge you to publicly apologize and remove your defamatory statements against my client on all platforms within three (3) days of receiving this notice; otherwise, my client will be forced to initiate appropriate legal action against you, including pursuing civil and criminal defamation at your expense. Additionally, I request a compensation of INR 10 crore for the mental distress and damage to my client's reputation caused by your Facebook post dated June 7, 2024." This notice was issued by Malviya, who also serves as the co-in-charge for BJP in Bengal.

Sinha, who has ties to BJP leader Rahul Sinha, previously claimed in his now-deleted post that Malviya engaged in immoral activities, including the exploitation of women.

The Hindu Samhati, based in West Bengal, is an organization devoted to promoting Hindutva among Bengali people. The group is known for its support of the BJP and aims to launch an anti-love jihad initiative in the state governed by the Trinamool Congress.
