The court affirmed the acceptance of the B Report (closure report) against Siddaramaiah, Parvati, Swamy, and Devaraj. Importantly, the ongoing investigation against the other accused individuals will continue, with a Final Report to be submitted upon completion.
The court also stated, "The application by the complainant seeking to initiate contempt proceedings against the investigating officer is hereby dismissed."
Moreover, the court remarked, "The Enforcement Directorate (ED) has the right to intervene in this case as aggrieved parties to a limited degree. The office is directed to return the CD files and draft copy of the final report maintained in a sealed cover to the concerned investigating officer upon proper identification. A call for the final report submission is scheduled for February 9."
It is noteworthy that the Enforcement Directorate (ED), Bengaluru Zonal Office, has provisionally attached Proceeds of Crime valued at Rs 460 crore in connection with this case under the provisions of PMLA, 2002.
The ED's investigation commenced following an FIR lodged by the Lokayukta Police in Mysuru, addressing a large-scale scandal regarding the unlawful allotment of sites by the Mysuru Urban Development Authority (MUDA).
Search operations uncovered that the site allotments were made in blatant violation of a directive dated March 14, 2023, and a government order dated October 27, 2023.
Additionally, these actions unveiled a significant nexus between MUDA officials and real estate developers. Evidence indicated cash payments for site allotments as compensation and layout approvals.
