Should Further Adjournments Be Granted in the Petition Against Wangchuk’s Detention?
Synopsis
Key Takeaways
New Delhi, Feb 9 (NationPress) The Supreme Court issued a warning on Monday against any additional adjournments in the habeas corpus petition lodged by Gitanjali J. Angmo, spouse of the incarcerated climate activist Sonam Wangchuk from Ladakh. This petition challenges his detention under the National Security Act (NSA).
During the proceedings, Additional Solicitor General (ASG) K.M. Nataraj, representing the Union government and the Union Territory of Ladakh, requested an extension citing his involvement in another case and proposed that the hearing be rescheduled for next week. The apex court rejected this request, stating: “It is crucial to recognize this is a habeas corpus matter. We regret that we couldn’t address it last Friday (February 5).”
The Bench, comprising Justices Aravind Kumar and Prasanna B. Varale, inquired whether any measures had been taken regarding its previous suggestion to reassess Wangchuk’s detention based on health considerations.
In reply, the law officer remarked that Wangchuk was receiving the “best of treatment”, asserting that the medical facilities at AIIMS Jodhpur surpassed those available in Ladakh.
After several appeals, the Supreme Court consented to schedule the habeas corpus petition brought forth by Dr. Gitanjali J. Angmo, which describes her husband Sonam Wangchuk’s detention as “illegal” and an “arbitrary exercise violating his fundamental rights”, for a hearing on Wednesday at 2 p.m.
Previously, during an earlier session, the apex court had informally urged the Union government to reconsider the ongoing preventive detention of Wangchuk.
While discussing the case, the Justice Aravind Kumar-led Bench pointed out that Wangchuk had been held in custody since September 26, 2025, and the medical documentation submitted to the apex court indicated that his health was “certainly not very good.”
ASG Nataraj was encouraged to consider whether there was any possibility of reevaluating the decision to continue Wangchuk’s detention. At that time, Nataraj assured the Supreme Court that he would seek guidance from the relevant authorities.
