Senator Ben Ray Lujan criticized former President Donald Trump for “sparking a global trade conflict from day one by unlawfully implementing extensive tariffs, hurting countless Americans in the process.”
The suggested Tariff Refund Act of 2026 mandates complete refunds, including interest, for tariffs levied under the International Emergency Economic Powers Act (IEEPA). Lawmakers estimate that the total collected by the administration stands at approximately $175 billion.
“The extensive and reckless tariffs imposed by President Trump have led to increased costs and negatively impacted small businesses and working families throughout New Mexico and the nation,” Lujan stated.
He continued, “This is why I am collaborating with fellow Senate Democrats to propose legislation that ensures the Trump administration provides reassurance to New Mexico’s small businesses by refunding the burdens they have faced.”
Senator Ron Wyden expressed, “Trump’s unlawful tax strategy has inflicted lasting harm on American families, small enterprises, and manufacturers who have suffered from continuous waves of new tariffs.”
He emphasized, “A vital initial measure is to assist those in greatest need by restoring funds to small businesses and manufacturers without delay.”
Senator Edward Markey remarked, “The unlawful tariff taxes imposed by Trump have cost small businesses, consumers, and families close to $175 billion. This amount needs to be repaid immediately.”
Markey also noted that small businesses might find the refund process complicated and highlighted that the proposed bill would ensure refunds are prioritized for small importers, simplifying the process and removing unnecessary administrative hurdles.
Senator Jeanne Shaheen pointed out that the tariffs have “only brought uncertainty and hardship—escalating prices for consumers and businesses when they can least manage it.”
She added, “Now that the Supreme Court has clarified that the President lacked the authority to unilaterally impose extensive emergency tariffs, it is imperative that American families and small businesses receive the relief they deserve.”
The legislation instructs the US Customs and Border Protection to refund, along with interest, all duties levied under IEEPA within 180 days of the law's enactment. The agency is required to prioritize small businesses and work alongside the Small Business Administration to provide necessary information and assistance. Additionally, CBP must report to Congress every 30 days on the progress of refunds.
In a separate statement, Congressman John Garamendi praised the Supreme Court ruling. “Trump believes he is above the law, Congress, and the Constitution. That notion was challenged on Friday,” he remarked, calling the decision “a significant victory for Americans struggling to meet basic needs,” mentioning that he had signed an amicus brief contesting the tariffs.
This legal battle originated from lawsuits filed by multiple states claiming that the President had overstepped his authority under IEEPA. Prior rulings by lower courts had favored the challengers before the Supreme Court's decision.
