The Bombay Bar Association (BBA) on Monday, 8 June passed a strongly worded resolution condemning reported threats, intimidation, harassment, and acts of violence against former Bombay High Court judge Justice Gautam Patel and members of his family. The incidents are linked to a judgment delivered by Justice Patel in proceedings connected to the Syedna succession dispute.

What the Resolution States

The BBA described media reports of the alleged threats as a matter of 'grave concern' and demanded a 'prompt, thorough and effective investigation' into each incident. 'The Association records its strongest condemnation of any attempt to threaten, intimidate, harass, assault or otherwise target a Judge or members of a Judge's family on account of the discharge of judicial functions,' the resolution stated.

The bar body further noted that reports of a family member of Justice Patel sustaining physical injury during one of the alleged incidents made the matter 'particularly disturbing' and warranted 'the most serious attention' of the authorities.

Attack on Judicial Independence, Says BBA

'Violence or threats of violence against judges or their families strike at the very heart of judicial independence and constitute a blatant assault on the rule of law,' the resolution declared. The BBA stressed that judicial decisions may be questioned or challenged only through lawful means — including appellate remedies — and that resorting to threats or coercion 'has no place in a civilised society and cannot be tolerated.'

Notably, the resolution framed the alleged conduct not merely as an attack on an individual judge but as an assault on the judiciary as an institution and on the constitutional guarantee that disputes be resolved by courts 'free from fear, favour, affection or ill-will.'

Call for Diplomatic Intervention

The BBA also urged the Union Ministry of External Affairs to take up the matter with authorities in England, indicating that at least some members of Justice Patel's family are based there. The association called on the government to ensure the safety and security of those family members abroad.

The resolution was signed by BBA President Nitin Thakker and expressed the association's 'earnest hope and expectation that the perpetrators of these reprehensible acts will be brought to book at the earliest.'

Background: The Syedna Succession Dispute

The Syedna succession dispute is a long-running legal battle within the Dawoodi Bohra Muslim community over the rightful successor to the position of Syedna — the community's supreme religious head. Justice Patel had presided over proceedings related to this dispute during his tenure at the Bombay High Court. Such succession cases are among the most sensitive and community-polarising matters that come before Indian courts.

What Happens Next

With the BBA now formally on record and calling for both a domestic investigation and diplomatic engagement, pressure is likely to mount on law enforcement agencies and the Ministry of External Affairs to respond. The association's demand that all those responsible be 'identified, apprehended and prosecuted' signals that the legal fraternity will closely monitor the pace and rigour of any probe.
