Kolkata, Aug 14 (NationPress) The West Bengal government on Thursday approached a single-judge Bench of Calcutta High Court to obtain permission for filing an FIR against the Leader of the Opposition (LoP) in the West Bengal Assembly, Suvendu Adhikari. This request is linked to his involvement in the 'Nabanna Avijan' (march to the state secretariat) on August 9, an event that turned violent, coinciding with the first anniversary of the horrific rape and murder of a female doctor at R.G. Kar Hospital.
The state administration sought the Calcutta High Court's approval because the LoP is entitled to a “protection from FIRs” granted by the Supreme Court in 2022. The apex court ruled that any FIR against him must receive prior authorization from the court.
On Thursday, the government presented its case to Justice Jay Sengupta's single-judge Bench, requesting the necessary permission to proceed with the FIR against Adhikari.
During the hearing, Adhikari's legal representative contended that since the Supreme Court had extended protection to him, the High Court lacked jurisdiction to address the issue.
Concluding the session, Justice Sengupta’s Bench upheld the argument from the LoP’s counsel, stating that without new direction from an “appropriate” court, they could not entertain the case.
The anniversary of the tragic incident involving the junior doctor was disrupted by significant violence after clashes erupted between law enforcement and demonstrators at the 'Nabanna Avijan'.
The victim’s mother claimed that she was assaulted by police as she and other protesters attempted to march towards Nabanna.
Additionally, both the victim's mother and BJP leaders accused police actions of damaging a sacred conch shell-bangle on her wrist, a traditional symbol of married Hindu women in Bengal.
In the aftermath, five police personnel sustained injuries during the altercation, and on Tuesday, Kolkata Police summoned BJP MLA Ashok Dinda to respond to allegations of threatening police officers during the 'Nabanna Avijan' protest on August 9.
The MLA has been instructed to report to the New Market Police Station on August 17.
