Kolkata, Aug 14 (NationPress) On Thursday, the West Bengal government sought the approval of a single-judge Bench at the Calcutta High Court to file an FIR against the Leader of the Opposition (LoP) in the West Bengal Assembly, Suvendu Adhikari. This request stems from Adhikari's involvement in the 'Nabanna Avijan' (march to the state secretariat) on August 9, which turned violent, coinciding with the first anniversary of the tragic rape and murder of a female doctor at R.G. Kar Hospital. However, the court rejected the plea.
The state government approached the Calcutta High Court for this action because the LoP is granted “protection from FIRs” by the Supreme Court since 2022. The apex court mandated that state authorities must obtain court permission prior to registering an FIR against him.
On Thursday, the state government presented its case to Justice Jay Sengupta of the single-judge Bench to seek authorization for filing an FIR against Adhikari.
During the hearing, Adhikari's legal representative contended that the protection provided by the Supreme Court meant that the Calcutta High Court lacked jurisdiction to hear the case.
Ultimately, Justice Sengupta’s Bench concurred with the arguments of LoP Adhikari's counsel, stating that without fresh directives from “an appropriate” court, his Bench could not proceed with the matter.
The violent protests on the first anniversary of the horrific incident involving a junior doctor of RG Kar Medical College and Hospital on August 9 were marked by clashes between law enforcement and demonstrators participating in the 'Nabanna Avijan'.
The victim's mother accused the police of assaulting her after she, along with her husband and fellow protesters, attempted to march toward Nabanna.
It was also reported that the police action resulted in the breaking of her sacred conch shell-bangle, a traditional symbol of married Hindu women in Bengal.
Moreover, five police officers sustained injuries during the altercations with protesters, and on Tuesday, the Kolkata Police summoned BJP MLA Ashok Dinda to appear regarding allegations of threatening policemen during the 'Nabanna Avijan' on August 9.
