BJP Legislators Approach Delhi High Court for Special Assembly Session to Present CAG Reports

New Delhi, Dec 23 (NationPress) A group of BJP legislators has recently approached the Delhi High Court, seeking an order for the Speaker of the Delhi Legislative Assembly to convene a special session to present the CAG Reports.

On Monday, the issue was brought before a bench headed by Acting Chief Justice (ACJ) Vibhu Bakhru, which instructed that the plea be scheduled for regular listing. According to a lawyer associated with the case, it is expected to be heard on Tuesday.

The significantly delayed CAG reports reportedly address the alleged shortcomings of the city government concerning the now-rescinded excise policy, anti-pollution initiatives, and various other financial issues that could potentially embarrass the AAP-led government right before the upcoming Assembly elections.

The recent petition submitted by BJP MLAs Vijender Gupta, Mohan Singh Bisht, Om Prakash Sharma, Ajay Kumar Mahawar, Abhay Verma, Anil Bajpai, and Jitender Mahajan highlighted that the Speaker did not convene a special session of the Delhi Legislative Assembly, despite a promise made to the Delhi High Court during a previous legal proceeding.

“This constitutes a blatant violation of the statement/commitment made by the Senior Counsel representing the GNCTD before this Hon’ble Court, for which the petitioners are prepared to pursue contempt of court if necessary,” the petition stated.

Last week, the Delhi HC dismissed a similar plea from BJP legislators that sought a directive to the city government to forward the CAG reports to the Lt. Governor (L-G). This was after it was confirmed that L-G Vinai Kumar Saxena had already approved the 14 CAG reports submitted by Chief Minister Atishi.

The court noted that CM Atishi, who also serves as the Finance Minister, is expected to forward these approved reports to the Speaker of the Delhi Legislative Assembly within 2-3 days. Subsequently, the Speaker will make a decision regarding the convening of a special session to table the CAG reports.

The petition emphasized that the CAG serves as a constitutional watchdog, established to provide independent and credible assurance to the public, the legislature, and the executive regarding the efficient and effective collection and expenditure of public funds.
