Should the Calcutta HC Halt the Construction of a Babri Masjid-Style Mosque in Murshidabad?
Synopsis
Key Takeaways
Kolkata, Dec 10 (NationPress) A Public Interest Litigation (PIL) was submitted to the Calcutta High Court on Wednesday, requesting an order to cease the construction of a mosque resembling the Babri Masjid in the Murshidabad district, a project initiated by the suspended Trinamool Congress leader and Bharatpur MLA Humayun Kabir.
The PIL was presented before the bench led by Acting Chief Justice Sujoy Paul. The court has accepted the petition, and a hearing is anticipated next week.
The petitioner contends that the name Babri Masjid is associated with the highly contentious Babri Masjid-Ram Janmabhoomi dispute in Ayodhya.
This construction could potentially disturb the communal harmony in the state, leading to social unrest. Additionally, the petitioner questioned how Humayun Kabir, despite being suspended, is proceeding with construction without the district administration's approval.
It was argued that Kabir’s actions infringe upon the fundamental rights guaranteed by Articles 14, 21, and 25 of the Indian Constitution. Thus, the petitioner urged the court to promptly issue a stay on the mosque's construction.
Notably, controversy has surrounded Kabir's decision to lay the foundation stone of this mosque in Beldanga over the past week.
On December 4, the leadership of Trinamool Congress suspended Kabir from the party due to his alleged anti-party activities.
In defiance of his suspension, Kabir proceeded with the foundation-laying ceremony on December 6.
He announced that construction would commence in the first week of February in Beldanga, with recitation of the Quran by one lakh voices scheduled for the day before construction starts.
On December 4, West Bengal Chief Minister Mamata Banerjee emphasized that the residents of Murshidabad would reject any form of communal politics. Her statement followed the suspension of Kabir, who was accused of fostering communal tension with his plans for the mosque.
During a public meeting in Berhampore, CM Banerjee remarked, "Trinamool Congress does not engage in communal politics and stands firmly against it. We must honor the historic legacy of Murshidabad, where figures like Siraj-ud-Daulah are cherished. This district is home to sacred sites of all religions, and its people will not tolerate politics inciting riots."
