Nagpur, June 28 (NationPress) Chief Justice of India B. R. Gavai remarked on Saturday that the nation has consistently demonstrated unity and resilience in the face of crises.
“Babasaheb Ambedkar faced criticism regarding the Constitution's perceived centralism, asserting that it balances both centralism and federalism. In response to such criticism, Babasaheb stated that the Constitution is neither solely central nor federal. We are crafting a Constitution that addresses all challenges, ensuring the nation remains united during both conflict and peace. Reflecting on our 75-year journey, we can observe the circumstances surrounding us, particularly in Pakistan, Bangladesh, Sri Lanka, and Nepal. Whenever this nation has encountered a crisis, it has remained united and strong,” declared the CJI at the inauguration of the country's first Constitution Preamble Park at Dr. Babasaheb Ambedkar Law School, Nagpur University.
The event was graced by Chief Minister Devendra Fadnavis and Union Minister Nitin Gadkari, among others. The CJI was also honored for taking on the role of CJI on May 14.
Touching on the Supreme Court ruling that supported the abrogation of Article 370, the CJI emphasized that it aligns with Dr. Babasaheb Ambedkar’s assertion that the country requires a single Constitution. “The Supreme Court recognized the necessity for governance under one Constitution,” he remarked.
The CJI praised Dr. Babasaheb Ambedkar’s role in unifying the nation through the Constitution and highlighted the park's significance in Nagpur, where Ambedkar embraced Buddhism.
Earlier, during a speech at a felicitation event organized by the Nagpur District Court Bar Association, the CJI emphasized that the judiciary should not interfere in every issue, advocating for a careful balance between activism and restraint in upholding constitutional values.
He underscored the importance of maintaining constitutional boundaries among the three branches of democracy and warned against judicial overreach. CJI Gavai asserted that the judiciary, executive, and legislature must function within their constitutional limits, with the judiciary intervening only when laws breach constitutional principles. He further cautioned that judicial activism should not devolve into judicial terrorism or adventurism.
The CJI paid tribute to Dr. Babasaheb Ambedkar, attributing his success to the Indian Constitution and Ambedkar’s vision, describing the Constitution as a remarkable document that guarantees social, economic, and political justice.
