New Delhi, April 18 (NationPress) The Delhi High Court has mandated the Municipal Corporation of Delhi and the city government to take decisive action against illegal encroachments along the Yamuna Pusta Road, which connects Wazirabad to Hiranki and is an essential route for both residents and commuters.
A bench led by Justice Sachin Datta instructed on Thursday that the designated executive engineer of the MCD must address the issues raised in the petition within eight weeks, in collaboration with members of the Yuva Samiti, a registered society dedicated to the welfare and progress of Jagatpur Village and its neighboring areas.
In disposing of the plea filed under Article 226 of the Constitution, the bench clarified that it has refrained from judging the merits of the case, leaving all rights of the litigant open, including the possibility of filing a new petition if the raised issues remain unresolved.
The petition asserts that Yamuna Pusta Road suffers from illegal encroachments in the form of unauthorized food stalls, parked vehicles, and roadside commercial storage, leading to traffic congestion, infrastructure deterioration, and heightened risks to public safety.
“Moreover, the road is cluttered with unmarked natural obstacles like trees and overgrown shrubs, which were neglected during road construction due to the authorities' failure to properly transplant or remove them. These hazards are particularly dangerous at night due to inadequate lighting,” stated the petition submitted through advocate Ashu Bidhuri.
The plea also pointed out that the streetlights installed along the entire stretch have remained out of order, leaving the road shrouded in darkness during nighttime.
It remarked, “This absence of lighting has not only escalated the risk of road accidents, especially at sharp curves, but has also fostered an environment conducive to criminal activities such as theft, chain snatching, and molestation, particularly putting women, children, and the elderly in danger.”
The petition highlighted that the situation is worsened by the indiscriminate placement of oversized and overflowing dustbins along the road, obstructing traffic flow, contributing to environmental pollution, and attracting stray animals such as dogs, pigs, cows, and buffaloes.
Furthermore, the plea noted that multiple representations and complaints had been made to various authorities, including the Chief Minister, municipal engineers, and police officials, yet no corrective action has been taken.
