Delhi High Court Grants Temporary Suspension of Sentence for Expelled BJP MLA Kuldeep Sengar

New Delhi, Dec 10 (NationPress) The Delhi High Court on Tuesday ordered a temporary suspension of the sentence for expelled BJP MLA Kuldeep Singh Sengar concerning the death case of the Unnao rape victim’s father.
A bench led by Justice Manoj Kumar Ohri acknowledged the claim that Sengar is experiencing severe lower back pain accompanied by Radiculopathy, an infection in the lower gastrointestinal tract, Periodontitis, anxiety, and sleep disorders.
Sengar’s application argued that he would suffer irreparable harm if his sentence was not temporarily suspended and he was not granted release.
Previously, on December 5, a bench of Justices Prathiba M Singh and Amit Sharma provided Sengar with interim bail for two weeks due to his critical health condition. He is currently serving a life sentence for raping a minor girl in Unnao in 2017.
The court instructed AIIMS Delhi to conduct an initial assessment of Sengar to determine whether his medical issues could be addressed in the national capital or if a referral was necessary.
The Delhi HC mandated that Sengar must not attempt to contact the rape survivor and must report to the investigating officer daily.
With a 10-day suspension of his sentence in connection with the death case of the survivor's father, Sengar is poised for temporary release on medical grounds.
Sengar's plea challenging the trial court's ruling in the rape case is still pending before the Delhi High Court, where he seeks to overturn the trial court's December 16, 2019 conviction and the subsequent December 20, 2019 life sentence.
The trial court had found Sengar guilty under various sections of the IPC and imposed a fine of Rs 25 lakh on him.
Furthermore, in March 2020, a special court sentenced Sengar, his brother Atul Singh, and five others to 10 years’ imprisonment in connection with the death of the Unnao rape survivor's father in 2018.
The court found them guilty of conspiracy, culpable homicide, evidence tampering, creating false records, wrongful restraint, and violations under the Arms Act.
The trial commenced on August 5, 2019, following a Supreme Court directive to transfer all five related cases from Unnao to Delhi.
The Supreme Court mandated that the trial be conducted on a daily basis and concluded within 45 days.
Sengar was expelled from the BJP and disqualified from the Assembly following his conviction by the trial court.
