Did the Delhi HC Suspend Kuldeep Singh Sengar's Sentence in the Unnao Rape Case?
Synopsis
Key Takeaways
New Delhi, Dec 23 (NationPress) In a significant turn of events, the Delhi High Court has provided conditional relief to expelled BJP leader Kuldeep Singh Sengar by suspending his life sentence related to the 2017 Unnao rape case.
A Division Bench comprising Justices Subramonium Prasad and Harish Vaidyanathan Shankar granted bail to Sengar while he appeals his conviction.
The Bench, led by Justice Prasad, ordered Sengar's release on a personal bond of Rs 15 lakh, requiring three sureties of the same amount.
The Delhi High Court mandated that Sengar must not approach within a five-kilometre radius of the victim's residence and remain in Delhi during his bail period. It warned that any breach of these conditions would result in the revocation of bail.
Sengar is also required to report weekly to the local police station, refrain from threatening or influencing the survivor or her mother, and deposit his passport with the trial court.
While suspending the sentence until the appeal is resolved, the Justice Prasad-led Bench scheduled Sengar's criminal appeal and associated applications for a hearing on January 15, 2026, pending the Chief Justice's orders.
Despite this bail provision, Sengar is expected to remain incarcerated as he is currently serving a 10-year sentence related to the death of the survivor's father in 2018.
In December 2019, Sengar was convicted for the rape of a minor girl, sentenced to life imprisonment, and fined Rs 25 lakh.
The Unnao rape survivor, a minor at the time, was reportedly kidnapped and sexually assaulted by Sengar in June 2017. The trial commenced in August 2019 following the Supreme Court's directive to transfer all related cases from Uttar Pradesh to Delhi.
The apex court also mandated that the trial be conducted daily and concluded within 45 days.
In the aftermath of his conviction, Sengar was expelled from the BJP and disqualified from his position in the Uttar Pradesh Legislative Assembly.
