Delhi High Court Approves 14-Day Interim Bail for Expelled BJP Legislator Kuldeep Sengar

New Delhi, Dec 5 (NationPress) The Delhi High Court on Thursday approved a two-week interim bail for expelled BJP MLA Kuldeep Singh Sengar, who is currently serving a life sentence for the rape of a minor girl in Unnao in 2017, citing his critical health condition.

A bench led by Justice Prathiba M Singh instructed AIIMS Delhi to conduct an initial evaluation to assess whether Sengar's medical issues can be treated in the capital or if they necessitate a referral elsewhere.

The bench, which also included Justice Amit Sharma, stipulated that Sengar must not attempt to contact the victim and must maintain daily communication with the investigation officer.

During the proceedings, Sengar's attorney argued for his release on interim bail, highlighting his worsening medical state.

According to his lawyer, Sengar is afflicted with diabetes, cataracts, retinal detachment, and other serious health complications.

The request for bail faced opposition from the victim's counsel, who expressed concerns about the potential threat to the survivor and her family.

The survivor's lawyer contended that Sengar should receive medical attention within the confines of the prison.

Sengar is currently appealing the trial court's ruling in the rape case at the Delhi High Court, seeking to overturn the court's December 16, 2019 conviction and the December 20, 2019 life sentence.

The trial court had found Sengar guilty under various sections of the IPC and imposed a fine of Rs 25 lakh on him.

Furthermore, in March 2020, a special court sentenced Sengar, his brother Atul Singh, and five others to 10 years’ imprisonment in connection with the death of the Unnao rape survivor's father in 2018.

The court convicted them under several IPC sections for crimes including conspiracy, culpable homicide, evidence tampering, and wrongful restraint, as well as violations of the Arms Act.

The trial commenced on August 5, 2019, after the Supreme Court mandated the transfer of all related cases from Unnao to Delhi.

The apex court ordered that the trial proceed on a daily basis and be concluded within 45 days.

Following his conviction, Sengar was expelled from the BJP and disqualified from the Assembly.
