Jammu/New Delhi, March 21 (NationPress) The Patiala House court in Delhi on Friday denied the regular bail application of J&K Lok Sabha member, Engineer Rashid.
Currently, Engineer Rashid is incarcerated in Tihar Jail after his arrest by the NIA in a 2017 terror funding case, under the Unlawful Activities (Prevention) Act, back in 2019.
Additional District Judge, Chander Jit Singh, delivered the ruling today, stating: "The bail application is dismissed".
This week, Engineer Rashid contested the trial court's decision from March 10, which had denied him custody parole or interim bail to attend the Lok Sabha session until April 4.
Engineer Rashid successfully contested the 2014 Lok Sabha elections from J&K’s Baramulla constituency. He submitted his nomination from Tihar Jail and triumphed over his opponent, National Conference Vice President Omar Abdullah, who is currently the J&K CM, by a margin exceeding 200,000 votes.
In response to his bail request, the NIA argued that Engineer Rashid should not be permitted to evade the consequences of imprisonment due to his parliamentary status.
The NIA opposed the bail, asserting that the accused has no entitled right to receive either custody parole or interim bail while in lawful custody to attend Parliament.
He had previously been granted interim bail following his Lok Sabha victory to care for his ailing parents.
During his time on interim bail, Engineer Rashid actively campaigned for candidates from his party, the Awami Ittehad Party (AIP), during the J&K Assembly elections.
His party managed to secure only one seat - the Langarh Assembly constituency, which was won by his brother Sheikh Khursheed Ahmad.
This constituency was represented by Engineer Rashid twice in the former 90-member J&K Assembly.
