India has experienced a significant transformation in its labour regulation landscape with the introduction of four consolidated labour codes.
These four Labour Codes are the Code on Wages, 2019; the Industrial Relations Code, 2020; the Code on Social Security, 2020; and the Occupational Safety, Health and Working Conditions Code, 2020.
The Occupational Safety, Health and Working Conditions Code (OSH), 2020, has been enacted to streamline and simplify the intricate network of existing labour laws. It amalgamates 13 Central Labour laws into a single, comprehensive legislation, thus minimizing complexity and establishing uniformity across various industries and States/UTs.
“This code was introduced as part of a larger initiative to reform labour laws aimed at enhancing transparency, boosting worker welfare, and facilitating ease of business operations in India,” stated an official announcement.
According to the code, every factory employing 500 or more workers, employers with 250 or more Building and Other Construction Workers (BOCW), and those employing 100 or more mine workers are mandated to form a safety committee comprising representatives from both employers and employees.
“The code now covers health, safety, and welfare for all workers in various sectors, expanding beyond the previous limitation to only seven sectors, such as factories, mines, plantations, beedi-cigar, dock workers, BOCW, and motor transport,” the statement highlighted.
Every employee will be entitled to complimentary annual health check-ups. Additionally, plantation employers can now access the ESI facility for medical services.
“This provision will enable early disease detection, lower medical expenses, and enhance workforce health and productivity,” the statement elaborated. It aims to promote preventive healthcare, mitigate long-term occupational risks, and provide industry advantages, such as reduced absenteeism and improved productivity.
Moreover, the National Occupational Safety and Health Advisory Board will establish national benchmarks for occupational safety, health, and working conditions, which will be obligatory for states to adhere to, ensuring compliance with strict quality standards nationwide.
The Social Security fund is designed to protect work-life balance, guarantee fair compensation for extra hours worked, advocate for transparent overtime practices with worker consent, and create opportunities for higher earnings through overtime at a premium rate (double the regular wage).
