“Being a public official, you ought to possess the courage to face the trial,” the panel remarked.
In light of this development, the CID has ramped up its search efforts, as Basavaraj now faces the choice of either surrendering to the investigators or going to the appropriate court to file a standard bail application before the Special Court for MLAs/MPs.
Basavaraj was already under the threat of imminent arrest following the Karnataka High Court’s dismissal of his anticipatory bail application earlier this week.
A bench led by Justice Sunil Dutt Yadav issued the ruling after rescinding the interim protection from arrest that had been previously granted.
After the High Court’s ruling, CID agents initiated a search operation to locate the MLA, with sources indicating that Basavaraj had gone into hiding, and police officials asserted that his arrest could happen at any time.
Previously, the High Court had provided Basavaraj with temporary protection from arrest.
The murder of rowdy-sheeter Biklu Shiva occurred on July 15 of the previous year in the Halasuru area of Bengaluru.
Investigators are believed to have compiled substantial evidence against the MLA. CID sources have indicated that his custodial interrogation is vital to further the investigation and to reveal the broader conspiracy surrounding the murder.
Basavaraj has been charged with murder and is recognized as the fifth accused in the case concerning the killing of Biklu Shiva, who was brutally attacked in front of his home. The Bharatinagar police in Bengaluru registered a First Information Report (FIR) against the MLA based on a complaint lodged by the victim’s mother.
The situation took a dramatic twist when the deceased’s mother asserted that she had never mentioned the name of the BJP MLA in her complaint and was unaware of how his name had been included in the FIR. Nonetheless, police later confirmed that they had established Basavaraj's alleged connections with the main accused.
Investigators claim that Basavaraj had direct ties with the rowdy Jagadeesh alias Jagga, the primary accused, and had met with Biklu Shiva multiple times before the murder.
Notably, Basavaraj was previously affiliated with Chief Minister Siddaramaiah before joining the BJP.
