Patna, April 10 (NationPress) The Patna High Court voiced its strong discontent on Friday regarding the escalating air and noise pollution levels in the city, criticizing local authorities for their inability to enforce existing regulations.
During the court proceedings, a single-judge bench led by Justice Rajiv Roy noted that the Bihar State Pollution Control Board (BSPCB) has failed to manage pollution effectively within the city limits.
Representing the Board, Senior Advocate Shivendra Kishore presented an action report, claiming that notices were issued to wedding venues and that construction sites were instructed to install green nets.
However, Amicus Curiae Ajay Kumar challenged these assertions, pointing out the lack of documented evidence of communications sent to municipal authorities.
The Court also examined the operational effectiveness of the police.
While the Rupaspur Police Station cited a delay in receiving information, the Kadamkuan Police Station admitted that despite an FIR being filed against a DJ operator, the involved vehicle lacked registration.
Expressing dissatisfaction, the Court queried why contempt proceedings should not be initiated against the relevant police officials.
Upon the request of state counsel Prashant Pratap, the Court provided a final opportunity for compliance.
Reports from police stations in Kankarbagh, Pirbahore, Alamganj, Rupaspur, Gandhi Maidan, and Buddha Colony were deemed inadequate, prompting the Court to issue stern reprimands to the respective Station House Officers (SHOs).
The Court emphasized that the Loudspeaker Act of 1955 and the Noise Pollution Rules must be enforced earnestly rather than remaining theoretical constructs.
In issuing firm directives, the Court mandated that DJs and loudspeakers employed during wedding processions (baraats) should be videotaped without disrupting the celebrations, with immediate legal action to be taken against any violations.
All six SHOs have been instructed to appear in person before the Court on June 19, bringing compliance reports.
Additionally, the Court has directed the organization of a “Run for Pollution” awareness initiative and has sought explanations concerning violations of noise regulations in Rajiv Nagar and Chappra Sadar.
It reiterated that, according to the Loudspeaker Act, the unauthorized use of loudspeakers is banned between 10:00 PM and 6:00 AM, empowering the police to act against offenders.
