This notice follows a collective petition sent to the state land and land reforms department, claiming that Sultana modified the classification of 0.2 acres of land in Beldanga, located in the minority-populated Murshidabad district of West Bengal, without obtaining prior approval from the appropriate authority.
The notice states that this alleged action breaches the stipulations of Section 4C of the West Bengal Land Reforms (WBLR) Act, 1955. This section mandates that a raiyat (landowner) must secure permission from the collector before changing the type, character, or usage of land (such as converting agricultural land into non-agricultural land).
Additionally, the collector holds the power to either grant or deny such requests, delineating the effective date for the conversion.
“Therefore, you are hereby requested to provide an explanation within 7 days from the receipt of this notice as to why suitable action should not be taken against you under Section 4D of the WBLR Act, 1955 for the aforementioned violations,” states the show-cause notice, a copy of which is accessible to IANS.
Notably, Beldanga is the planned site for the Babri Mosque, a project championed by Kabir, which aims to replicate the original structure in Ayodhya, Uttar Pradesh, that was demolished on December 6, 1992.
As the legislator representing the Bharatpur assembly constituency in Murshidabad, Kabir has questioned the timing of this notice, asserting that it was initiated long after the land had been developed and construction for the proposed mosque had begun.
“This is clearly a plot by the state government and the ruling Trinamool Congress,” he contended.
“I have repeatedly attempted to obtain a mutation since my house was built, but the relevant officials indicated it was unnecessary. Now, they are retaliating against me for leaving the Trinamool Congress. I will provide a strong legal response to the authorities,” Kabir declared.
