New Delhi, May 16 (NationPress) The Supreme Court is poised to hear the appeal of Madhya Pradesh's Tribal Affairs Minister Kunwar Vijay Shah on Friday, contesting a ruling from the Madhya Pradesh High Court that began suo motu contempt proceedings against him.
The High Court had taken notice of Shah's comments aimed at Colonel Sofiya Qureshi, the Indian Army officer who addressed the media regarding Operation Sindoor.
This issue was brought up for urgent consideration before the Chief Justice of India B.R. Gavai and Justice George Augustine Masih.
On Thursday, the Supreme Court raised concerns over the accountability of Minister Shah, who allegedly made derogatory statements about Colonel Qureshi.
"What kind of statements are you making?... A responsible Minister of the government, especially during challenging times for the nation... A person in a Constitutional role should exhibit a level of restraint. Every utterance from a Minister must carry a sense of responsibility," Chief Justice B.R. Gavai criticized Shah's comments regarding the female officer.
Shah, represented by senior lawyer Vibha Dutta Makhija, has sought the Supreme Court's intervention to stay a First Information Report (FIR) filed against him following the High Court's directive. The apex court has agreed to consider his case on May 16, 2025.
The Supreme Court advised the Minister's attorneys to notify the High Court, which had scheduled the case for May 15, about the hearing on May 16.
The High Court had taken suo motu cognizance of the Minister's remarks.
Makhija argued during an oral request for an expedited hearing that the comments were "unfortunately sensationalized" by the media.
The Minister was not afforded an opportunity to present his case before the High Court issued an order for the police to file an FIR.
She contended that the High Court may have overstepped its authority.
At that time, Chief Justice Gavai questioned why the Minister chose to approach the Supreme Court directly rather than pursuing his case within the High Court.
"Is it because he is a Minister that this should be entertained here?" Chief Justice Gavai inquired of Makhija.
The senior lawyer responded that Shah had publicly expressed regret and possessed a recording of it.
On Wednesday, the Madhya Pradesh High Court ordered the Director General of Police (DGP) to file a criminal case against Shah within four hours and cautioned the DGP of potential contempt action in the event of non-compliance.
A panel of Justices Atul Sreedharan and Anuradha Shukla of the Madhya Pradesh High Court noted that there appeared to be evidence of an offense aimed at inciting enmity among different castes, religions, and languages.
The Justice Sreedharan-led Bench expressed that referring to Colonel Sofiya Qureshi as a "sister of terrorists" constitutes an offense that insults the sentiments and beliefs of the Muslim community.
In discussing Operation Sindoor, Vijay Shah remarked on Monday that Prime Minister Narendra Modi had sent a "sister from the same community" as those in Pakistan to retaliate against the April 22 terror attack in Pahalgam, Kashmir.
"PM Modi is working for the society. Those who caused grief to our daughters in Pahalgam, we sent a sister of their own to give them a lesson," Shah stated.
The offensive remarks directed at Colonel Sofiya Qureshi, who played a key role in the media briefings throughout Operation Sindoor against Pakistan, ignited widespread outrage across the nation.
In the wake of the incident, the Minister expressed deep remorse and stated that he holds the Armed Forces in high regard, referring to Colonel Sofiya as "sister".
"I, Vijay Shah, feel not just ashamed but also saddened by my recent statement, which has offended the sentiments of every community, and I sincerely apologize. Our nation's sister Sofia Qureshi has performed her duties above caste and societal divisions," he stated in a video message shared on the social media platform X.
In his petition to the Top Court, Shah is seeking to annul the FIR as well as the suo motu proceedings initiated by the Madhya Pradesh High Court.
