Bengaluru, Jan 22 (NationPress) The Karnataka High Court on Thursday dismissed a plea from Congress leader Rajeev Gowda aimed at quashing the FIR lodged against him due to allegations of using abusive language and issuing threats via phone to a woman Municipal Commissioner regarding the removal of a banner in Sidlaghatta town.
The ruling was made by a Bench led by Justice M. Nagaprasanna on Thursday.
Rajeev Gowda, who contested the last Assembly elections from Sidlaghatta, is presently absconding.
In the meantime, the prosecution has submitted objections to Gowda’s bail request before the Second Additional District and Sessions Court in Chikkaballapur. An interim bail application was filed on Saturday.
It is noteworthy that the Karnataka High Court criticized Rajeev Gowda on Tuesday regarding this matter and questioned why the government had not pursued more serious charges against him.
The High Court Bench, led by Justice M. Nagaprasanna, reprimanded the petitioner, Rajeev Gowda, while reviewing the plea to dismiss the FIR. Rajeev Gowda is currently evading law enforcement, and the petition was filed through his attorney.
The court raised concerns as to why sections 71 (serious sexual offences against women and children) and 79 (words, sounds, gestures, or objects intended to insult a woman’s modesty or intrude upon her privacy) were not applied against the accused, despite his alleged use of foul language toward a female officer.
“Does the petitioner have no respect for women? How is it possible for him to speak in such a manner? Words cannot be retracted once spoken. A careless comment can ruin everything,” the Bench noted.
The court further emphasized that even an apology would not amend the mindset that caused the distress. The Bench decided to reserve the case for judgment and adjourned the proceedings.
The Karnataka Pradesh Congress Committee (KPCC) on Wednesday proposed the suspension of Rajeev Gowda in connection with the case. The incident has garnered national attention and brought significant embarrassment to the ruling party.
The party remarked, “The statements made by Rajeev Gowda have been widely disseminated in the media, causing serious embarrassment to the party and its leadership. The KPCC President has taken serious note of this issue and directed that the suspension of Rajeev Gowda from the party be referred to the KPCC Discipline Committee,” stated Chandrashekhar.
“In light of this, you are directed, as per the KPCC President's instructions, to investigate the matter according to established procedures and rules and to take immediate action regarding his suspension from the party,” he added.
