New Delhi, Dec 22 (NationPress) A Delhi court has reserved its decision on a request made by British citizen and alleged intermediary Christian Michel James, who is seeking changes to specific bail conditions in a corruption case associated with the purported AgustaWestland VVIP chopper scandal.
Special Judge Sanjay Jindal of the Rouse Avenue Courts held off on delivering a ruling after listening to arguments from both Michel's attorney and the Central Bureau of Investigation (CBI).
The court is expected to announce its verdict on Tuesday.
Michel has approached the legal system arguing that certain bail stipulations hinder his ability to gain freedom, despite previously being granted relief.
This appeal aims to alter the conditions that are obstructing his release from custody.
Just two days prior, a special court had ordered Michel's release in the money laundering case after acknowledging his commitment to continue participating in the trial if freed.
The Special Court (PMLA) highlighted that Michel has spent nearly seven years in custody during the trial, which is comparable to the maximum sentence for the alleged crimes.
Following this order, Michel expressed his satisfaction by stating that 'law prevailed.'
Nevertheless, his release is still on hold as the request regarding the modification of bail conditions in the CBI case is unresolved.
Michel is implicated in the Rs 3,600-crore alleged fraud involving the acquisition of 12 VVIP helicopters from AgustaWestland and faces multiple allegations of corruption, conspiracy, and money laundering. He was extradited to India from the UAE on December 5, 2018, leading to his arrest by the CBI and later by the ED. Since then, he has been detained at Tihar Jail.
The CBI asserts that the contract, signed on February 8, 2010, for the delivery of 12 VVIP helicopters valued at approximately Rs 3,600 crore, led to a loss of around Rs 2,666 crore to the government, while the ED claims Michel received kickbacks totaling 30 million euros (approximately Rs 225 crore).
