Kolkata, Sep 19 (NationPress) A division bench of the Calcutta High Court upheld a prior ruling from a single-judge bench on Friday, emphasizing the need for a thorough examination regarding the qualifications and eligibility of Kajori Banerjee, the sister-in-law of West Bengal Chief Minister Mamata Banerjee, for the role of President of the working committee at a prestigious girls' college in Kolkata.
On September 17, the single-judge bench, presided by Justice Bivas Pattanayak, raised concerns about how Kajori Banerjee, who is also a Councillor for the Kolkata Municipal Corporation (KMC), could be appointed as President of the working committee at Rani Birla Girls' College, despite lacking an educational background.
According to legal stipulations, the head of a college's management committee is expected to be someone connected to the field of education. Justice Pattanayak highlighted the necessity for a detailed hearing as it was unclear whether Kajori Banerjee's appointment adhered to this requirement.
“Thus, it is crucial to determine the legality of her (Kajori Banerjee's) appointment,” remarked the judge earlier this week.
Subsequently, Kajori Banerjee appealed to the division bench, consisting of Justice Tapabrata Chakraborty and Justice Reetobrata Kumar Mitra, contesting the single-judge bench's ruling.
Nevertheless, on Friday, the division bench dismissed her petition, thereby affirming the previous order made by Justice Pattanayak.
The division bench also noted that the matter would continue for further consideration at the single-judge level, with the next hearing scheduled for eight weeks from now.
On September 17, Justice Pattanayak's bench imposed an interim stay on a show-cause notice and suspension order that had been issued to the college's Principal, Srabanti Bhattacharya, by Kajori Banerjee last month.
This interim stay will remain effective for another eight weeks, with the next hearing set to occur following six weeks.
The show-cause notice and suspension order were initially issued on August 29.
The college principal also challenged these actions before Justice Biswajit Basu in the single-judge bench.
During the proceedings, the state government's counsel requested that Justice Basu recuse himself from the case, which he did after expressing discontent regarding such a request.
The case was later directed to the bench of Justice Pattanayak.
During the hearing on September 17, Justice Pattanayak ordered an interim stay on both the show-cause notice and the suspension order.
