Did the Delhi HC Block the Release of 'UP 77'?
Synopsis
Key Takeaways
New Delhi, Dec 24 (NationPress) The Delhi High Court has, on Wednesday, rejected a request for an interim order to halt the release of the forthcoming web series 'UP 77', which is claimed to be inspired by the life of the late gangster Vikas Dubey from Uttar Pradesh.
A single-judge Bench led by Justice Sachin Datta reviewed a writ petition submitted by Dubey’s spouse, Richa Dubey, and took note of the producer’s declaration that the series is purely fictional and does not depict any real individual.
Justice Datta further acknowledged the producer’s commitment to display a disclaimer indicating the fictional nature of the web series prior to each episode.
Moreover, the court documented the producer’s promise that none of the promotional materials would mention the name of the deceased gangster.
“The private respondents have also stated that they will issue a formal statement or press release addressing the petitioner’s concerns that the series does not reflect a true story. An affidavit confirming this will be submitted within two weeks,” Justice Datta remarked, opting not to impose any interim order to prevent the series' release at this time.
The case is scheduled for further discussion on January 7, 2026.
The series is set to premiere on December 25 on Waves, a streaming platform launched by Prasar Bharti.
Earlier this week, notifications were sent to the Union Ministry of Information and Broadcasting along with the OTT platform. During the proceedings, Richa Dubey’s attorney argued that although the series claims to be fictional, it borrows significantly from her husband’s life and the events surrounding his demise, causing substantial prejudice, stigma, and reputational damage to her and her children.
It was asserted that the series features unauthorized biographical portrayals, sensationalized personal events, and private matters, which constitutes an invasion of privacy and violates dignity under Article 21 of the Constitution.
She expressed concerns that the release would irreparably harm her dignity, resurface past traumas, and jeopardize her safety. Vikas Dubey’s village, Bikru in Kanpur, gained national attention in July 2020 when eight police officers were killed during an operation to apprehend him.
This incident sparked national outrage, leading to the deaths of Dubey and several of his associates in police encounters, while many others were arrested and subsequently sentenced.
