He pointed out that there were no opposing witnesses or recorded responses, leading to conclusions drawn without transparency or proper process.
Furthermore, he noted that the order fails to outline the scientific criteria utilized for the forensic analysis.
“There is a conspicuous absence of audio waveform analysis, metadata review, frame-by-frame examination, or timeline synchronization, which raises significant doubts about the reliability and thoroughness of the forensic investigation and the actual materials that were scrutinized,” Chugh stated.
He raised the critical issue of whether the official video record of the Delhi legislative Assembly proceedings was ever called for, questioning what video and which source were examined.
According to him, the Assembly's proceedings represent an official record, especially after AAP leader Atishi made controversial comments about Gurus in the Assembly. Ignoring that official record to draw conclusions from other sources contravenes the principles of judicial fairness and due process.
Chugh claimed that while the Mann government seeks time in Delhi concerning false cases related to Assembly proceedings, it simultaneously misleads the court by securing interim orders based on reports from agencies it controls.
He asserted that politicizing a highly sensitive issue such as the dignity of Gurus and crafting narratives through incomplete and unclear processes is not only improper but poses a threat to democracy and justice.
Chugh called for a prompt and unbiased investigation into the insults directed at Gurus. He warned that any administration in Punjab that tries to shield or cover for those who offend Gurus will face firm opposition.
Meanwhile, the Delhi Assembly Secretariat has requested the Punjab government to provide the forensic report concerning a video linked to AAP leader and Leader of the Opposition, Atishi, by January 22.
This development coincides with comments from Assembly Speaker Vijender Gupta, suggesting that a special session of the House may be called regarding the issue. Delhi Assembly Secretary Ranjeet Singh has sent a letter to the Punjab government's Forensic Science Laboratory in SAS Nagar (Mohali), stating, “Enclosed is a copy of the press statement purportedly issued by the Jalandhar Commissionerate of Police. It notes that a FIR has been filed concerning a video clip of the Delhi Assembly proceedings dated January 6, 2026.”
He further added: “The press statement from Punjab also indicated that the video underwent forensic examination and was found to have been intentionally altered. This statement was brought to the attention of the Assembly Speaker during the House session on January 9, 2026.”
“In light of these facts, you are hereby instructed to provide a written statement in this context, along with complete records, including the application from the police authorities and your office's report, to the undersigned by January 22, 2026.”
Addressing the media in Delhi, Speaker Gupta remarked, “Given the seriousness of the issue, the dignity of the Delhi Legislative Assembly, and the necessity to maintain democratic accountability, a special session of the House may be convened if necessary, as all decisions concerning this matter must be made by the House itself and not elsewhere.”
He noted that the Committee on Privileges of the Delhi Assembly has initiated proceedings regarding the situation.
