New Delhi, Nov 14 (NationPress) The National Green Tribunal (NGT) has mandated the Himachal Pradesh government to submit a comprehensive affidavit regarding the actions taken for the management and disposal of solid waste in Kullu district.
A Bench consisting of Judicial Member Justice Arun Kumar Tyagi and Expert Member Dr Afroz Ahmad was addressing a suo motu case that arose from a news report published on May 30, which featured alarming visuals of the popular hill station covered in litter.
In their directive, the NGT acknowledged that while the Himachal Pradesh High Court has already recognized the issue, the green tribunal's proceedings have advanced significantly, allowing both forums to exercise jurisdiction simultaneously.
“To prevent any conflicting orders, it is clarified that if such a situation arises, the order from the Hon’ble High Court will take precedence,” stated the Bench led by Justice Tyagi.
Highlighting the “scale of the issue” and the stipulations of the Solid Waste Management Rules, 2016, the NGT instructed the Kullu administration to establish “further suitable alternative arrangements” for waste disposal in collaboration with the District Environment Committee, chaired by the Deputy Commissioner.
The tribunal has also included the Chief Secretary of Himachal Pradesh as respondent no. 6, and the Principal Secretaries of the Urban Development and Rural Development Departments as respondents no. 7 and 8, respectively, in this matter.
Noting that the Environment (Protection) Act, 1986 has been modified through the Jan Vishwas (Amendment of Provisions) Act, 2023, the NGT stated that these changes empower authorities to impose penalties on both government entities.
The Chief Secretary of Himachal Pradesh has been instructed to issue necessary directives to the Adjudicating Officer for initiating suo motu proceedings against violations and to impose penalties on relevant government departments/officers as well as private offenders,” the order specified.
The Chief Secretary is required to file an affidavit, either personally or through an authorized officer, within two months, detailing specific initiatives taken for adherence to the Solid Waste Management Rules, 2016, in Kullu district.
The next hearing on this matter is scheduled for January 16 of the coming year.
